Ukraine and Netherlands Present Case Against Russia

Strasbourg — Deputy Head of the Office of the President of Ukraine, Iryna Mudra, represented the Ukrainian delegation at the oral hearings in the interstate case of Ukraine and the Netherlands v. Russia at the European Court of Human Rights (ECHR). The proceedings address the alleged human rights violations committed by Russia since the onset of its armed aggression in 2014.

    In her address, Mudra emphasized that Russia's aggressive actions blatantly contravene fundamental international law principles. The Ukrainian government substantiated these claims with robust evidence during the hearings. Numerous international observers and the ECHR have assessed these actions and underscored the Russian authorities' reluctance to document such widespread and systematic human rights violations. The Russian goal of this war has been clearly articulated by Russian officials on several occasions and is evident from their behavior. Russia aims to destroy and assimilate Ukrainians, disrupt public order in Europe, and undermine the global order,” stated Mudra.

    Ukraine anticipates that the ECHR will affirm the presence of human rights violations by Russia and advance to the stage of just satisfaction based on the oral hearings' outcome. The Ukrainian delegation included the Agent before the ECHR, Margarita Sokorenko, along with representatives from the Secretariat of the Agent before the European Court of Human Rights at Ukraine's Ministry of Justice.

    The case has drawn unprecedented international attention, with 26 states participating as third parties. This level of involvement, alongside the volume of complaints and the breadth of the claim, is unparalleled in the history of the ECHR's interstate case considerations. Notably, on January 25 last year, the ECHR ruled on the admissibility of this case, marking it as the first foreign judicial body to confirm that the territories of eastern Ukraine have been under occupation since May 11, 2014.
