Guaranteeing the States Protection Against Invasion

By Charles Hawes, Capital News WASHINGTON, D.C.— President Trump today signed an Executive Order aimed at addressing what he described as an "invasion" of illegal aliens entering the United States through the southern border. The order invokes Article IV, Section 4 of the U.S. Constitution, which guarantees federal protection for states against invasion, as well as presidential authority under the Immigration and Nationality Act. A Constitutional Promise to Protect States In joining the Union, the states agreed to surrender elements of their sovereignty in exchange for federal protection against foreign threats. This promise is enshrined in the U.S. Constitution. States such as Texas, faced with millions of illegal crossings and associated economic burdens, have repeatedly requested federal intervention during prior administrations.
